BIGGdesigns, llc hereby issues the designated CCC a license for limited use of the Authorized Materials. This is an exclusive non-transferable license for use by the designated CCC only. This license shall be for the limited use for preparation of submittals and/or as-built drawings only. These files are not to be used as the basis for any other project other than that listed above.
The CCC shall not use, copy, or distribute these documents in any form or use them for other projects than specified above. BIGGdesigns, llc is the sole owner of all copyrights pertaining to
these files. It is acknowledged that BIGGdesigns, llc prepared these CAD/PDF files. BIGGdesigns, llc cannot be held responsible for the completeness and accuracy of the information conveyed on these CAD/PDF files. The CAD files may not necessarily reflect all addenda, bulletins or other project revisions or communications to date. It is the CCC’s responsibility to verify accuracy and completeness.
The designated CCC assumes all liability for their use of these files for preparing submittals and as-built documentation. The CCC shall have a legally authorized individual endorse this statement. It shall be understood that the recipient will, to the fullest extent permitted by law, hold harmless and indemnify BIGGdesigns, llc and/or its consultants from all claims of liability for damages and/or cost associated with any use, modification or misuse by the recipient, or its affiliates of the electronic media released. This shall include attorney’s fees and/or BIGGdesigns, llc man-hours associated with any defense or actions taken.
Recipient is advised to check all electronic media for computer viruses before use of files. Recipient assumes full responsibility for intercepting and disabling viruses, if any that may be inadvertently transmitted with the electronic files. CCC hereby agrees to indemnify and hold BIGGdesigns, llc harmless from and against all claims of any type or nature asserted by recipient or any third party as a result of viruses inadvertently transmitted with the electronic media.
BIGGdesigns, llc has no contractual agreement with CCC. Any requested or required revisions to the plans will require the CCC to setup meeting to discuss changes to the Scope of Work, Services required, review new contractor(s), and sign a new agreement with BIGGdesigns, llc for services.
